Terms of Service

1. Acceptance of Terms

By accessing or using the GearShire platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

GearShire is a peer-to-peer marketplace that connects people who want to rent gear and equipment ("Owners") with those who need to borrow it ("Renters"). GearShire facilitates the transaction but is not a party to any rental agreement between Owners and Renters.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into binding agreements.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.

5. Listings & Rentals

5.1 Owner Responsibilities

Owners must accurately describe listed items, including condition, specifications, and availability. Owners are responsible for ensuring listed items are safe, functional, and comply with all applicable laws.

5.2 Renter Responsibilities

Renters agree to use rented items in a careful and lawful manner, return items by the agreed date and in the same condition (normal wear excepted), and pay all applicable fees including late fees for overdue returns.

5.3 Prohibited Items

The following may not be listed on GearShire: illegal items, weapons, hazardous materials, consumables, items requiring a license to operate, and any item whose rental violates local, state, or federal law.

6. Payments & Fees

GearShire processes all payments through third-party payment providers. GearShire charges a service fee on each transaction, which will be disclosed before you confirm a booking. Owners receive the rental amount minus applicable fees.

7. Disputes & Damage

GearShire provides a dispute resolution process for damage claims, returns, and other conflicts between Owners and Renters. GearShire reserves the right to mediate disputes and may, at its sole discretion, issue refunds or charge fees to resolve claims.

8. Prohibited Conduct

You agree not to: use the Service for any unlawful purpose; harass, abuse, or harm other users; interfere with the operation of the Service; scrape or reproduce content without permission; or attempt to circumvent fees or payment systems.

9. Limitation of Liability

To the maximum extent permitted by law, GearShire is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. GearShire's total liability is limited to the fees you paid in the 12 months preceding the claim.

10. Termination

GearShire may suspend or terminate your access at any time, with or without cause, including for violation of these Terms. Upon termination, you remain liable for any outstanding obligations.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or through the platform. Continued use after changes take effect constitutes acceptance.
